===== page 1 ===== UNITED STATES DEPARTMENT OF THE INTERIOR OFFICE OF THE SECRETARY WASHINGTON 25, D. C. For Signature DEC 8 1949 Dear Mr. Evape: This will refer to your letter of August 25, enclosing solution No. 3, to appropriate $6,000 from available trial funds no deposit at the Consolidated Chippewa Agency for the purpose of compiling tribal roll, and resolution No. 14, passed by the tribal executive committee on December 11, 1948, and ratified by the tribal delegates on May 21, 1949 dealing with enrollment. Under Article XIV of ecormtitu- the tribal constitution, the tribal executive committee may expend funds within its control. No action, therefore, is required by this Department with regard to resolution No. 3. Under Section 3 of Article II of the tribal consti- tion, Resolution No. 11 is subject to my approval. Resolution No. 11 provides as - ss follows: BE IT THEREBY RESOLVED, Indians not now enrolled as members of the Minnesota Chippewa Tribe, if able to so prove shall be enrolled if he or she is a descendant of a member of the Tribe; Provided that these rules shall not be in effect unless ratified by the Tribal Delegates in May, 1949, thereafter approved by the Secretary of Interior. It appears that the only qualification which an applicant for enrollment must possess if the foregoing resolution is approved is that he is a descendant of a member of the tribe. No minimum quantum of Indian blood is prescribed nor are any residential or affiliation require- ments included. It is possible, therefore, that this resolution is intended to accomplish the same purpose that Resolution No. 4, adopted sase purpose July 26, 1941, was intended to accomplish. The Assistant Secretary of the Interior refused to approve Resolution No. 4 for the reasons stated in his letter of December 23, 1942. By his letter of June 21, 1945, the Assistant Commissioner . of Indian Affairs called attention to the fact that another resolution, No. 31, to govern watership in the Minnesota Chippewa Tribe contained a provision which the Assistant Secretary had criticized when he refused to approve the earlier resolution. Because resolution No. 14 for all the reasons that Resolution No. 4 was disapproved - on December 23, 1942, to disapprove 10/7/49 Se 4 a Resolution No. 24.
